Workers Compensation
You’ve had an accident at work, or perhaps you’ve developed symptoms of a condition that may be work-related. The problem may or may not have been your fault. You may need medical care or physical therapy, and you may be unable to work at your regular job or weekly schedule.
When you are injured or made ill while performing work for an employer, a special and sometimes complex body of law controls who pays the bills and how much you can recover. Workers’ compensation insurance is designed to protect workers and their dependents against hardships that result from work-related injury or death. The goal is to protect both employee and employer: The employee receives compensation in exchange for forfeiting the common law right to sue the employer. The employer benefits by receiving immunity from court actions in exchange for accepting liability that is specifically limited. The question of negligence or fault is usually not at issue.
In short, workers’ compensation laws make the recovery of compensation for work-related injuries different than for other injuries. We can help you receive all the benefits to which you may be entitled.
Your employer’s workers’ compensation insurance coverage typically pays for reasonable and necessary medical care if you are hurt or become ill because of a work-related circumstance. Workers’ compensation insurance will also pay a portion of your regular wages or salary (typically weekly or biweekly) if you are unable to work–or your doctor recommends that you do not work–for a period of time.
Unfortunately, though, abuses of the workers’compensation benefit system have turned many insurance claims adjusters into adversaries who bring an attitude of suspicion to every claim. And too, a small number of insurance companies have a policy of routinely denying either some or all benefits when a claim is initially filed.
